WAIVER, RELEASE OF LIABILITY, AND TERMS AND CONDITIONS
I. Introduction. These Waiver, Release of Liability, and Terms and Conditions apply to all events, including both planned and unplanned activities, at the Three Otters Django Glamp Festival (referred to herein as the “Festival”). By registering, attending, or participating in any event, activity, or experience at the Festival, whether organized or unorganized, all attendees (referred to herein as “Participants”) agree to these terms.
II. Scope of Events. The events planned by Swingology, LLC (referred to herein as the “Organizer”) may feature a variety of activities, including musical performance, workshops, meals, social gatherings, and other events, and may also provide opportunities for alcohol consumption. Participants agree to engage in activities responsibly and understand that their participation in the Festival or any activity during the Festival is entirely voluntary, whether planned by Organizer or unplanned.
III. Express Assumption of Risk and Waiver of Liability; Medical Consent and Authorization.
A. Assumption of Risk. By registering for the Festival and/or entering the Festival premises, Participants acknowledge and agree that they do so at their own risk and assume full responsibility for any risks of bodily injury, death, or property damage arising from or related to participation in the Events, whether caused by the negligence of the Organizer or otherwise. This includes risks associated with physical activities, equipment use, outdoor and indoor recreation, consumption of alcohol or illicit substances, and the behavior of other Participants. Participant acknowledges that the Festival is being held in a wild and remote location that includes risks from wild animals and acts of nature, and Participant assumes all risks associated with all activities in such location.
B. Waiver of Liability. Participants hereby release, waive, discharge, and covenant not to sue Organizer, its officers, employees, members, agents, volunteers, partners, or sponsors from any and all liability to the Participant, their personal representatives, assigns, heirs, and next of kin for any loss, damage, or claim related to injury to person or property, or resulting in death of the Participant, whether caused by any negligent act or omission of the Organizer or otherwise, during or in connection with the Festival.
C. Medical Consent and Authorization. Each Participant grants permission for any person connected with the Organizer to provide necessary first aid and, in more severe cases, to call for medical care for the Participant. The Participant agrees to be solely responsible for all medical expenses incurred on behalf of themselves or the minor/individual. Participant further waives all claims and liabilities against any individual associated with Organizer or a Participant providing, obtaining, or seeking to obtain such first aid or medical care. Participant acknowledges that due to the remote location of the Festival, medical care or evacuation may be difficult, and Participant assumes all risks and waives all liability against Organizer related to the necessity, actual or perceived, of obtaining medical care.
IV. Compliance with Laws and Regulations; Prohibited Items and Behavior.
A. Compliance with applicable laws and regulations. Participants agree to comply with all applicable laws, statutes, ordinances, and regulations regarding their behavior and conduct at the event, and to adhere to safety guidelines as instructed by the Organizer or staff of Three Otters Eco Retreat.
B. Prohibited Items, and animals. Participants are prohibited from bringing weapons, fireworks, ATVs, animals (service or otherwise) or any items deemed dangerous or inappropriate by the Organizer onto the event premises.
C. Prohibited Behavior. Underage drinking will not be allowed. Participants agree to conduct themselves appropriately with due regard to the safety and enjoyment of all Participants. Organizer reserves the right to refuse entry to or remove any Participant conducting themselves in a manner that is disruptive, dangerous, or potentially harmful to themselves or others, offensive or likely to cause undue discomfort to other Participants, or that violates these terms and conditions.
V. Event Changes and Cancellations. Organizer reserves the right to make changes to the event schedule, activities, or terms, and to cancel or postpone events as necessary. In such cases, efforts will be made to inform Participants as promptly as possible. Organizer is not responsible for any costs or expenses Participants may incur as a result of event changes or cancellations.
VI. Indemnification. Participants agree to indemnify, defend, and hold harmless the Organizer, its officers, directors, employees, volunteers, partners, sponsors, agents, or representatives from and against any and all claims, demands, actions, lawsuits, damages, costs, or expenses, including attorney fees, arising out of or in any way related to their participation in or presence at the Festival, including but not limited to claims of negligence.
VII. Governing Law. These terms and participation in any event hosted by the Organizer are governed by and to be construed in accordance with the laws of the Commonwealth of Virginia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Virginia.
VIII. Electronic Acceptance and Compliance Agreement. By registering, attending an event, or being present at the event location, Participants agree to be bound by these terms and conditions, thereby waiving substantial legal rights. This waiver and release will be binding regardless of whether a physical or electronic signature is provided. Participants acknowledge
IX. Acknowledgment of Terms Upon Ticket Purchase and Presence. By registering for the Festival, attending the event, or being present at the event premises, including during setup or teardown phases, Participants hereby acknowledge that they have received, read, understood, and agree to the terms and conditions outlined in this Waiver, and Release of Liability, and Terms and Conditions. Their registration, attendance, or presence signifies that Participants fully agree to be bound by these terms, even if they have not provided a formal signature.
